I took legal advice and initiated a âCommunity Triggerâ Iâm now liaising with Nick Woolridge who oversees Tipton area for Sandwell Council.
I have also contacted my MP who has asked me to send him all my correspondence, CCTV footage etc. But I need the names of the two officers who investigated last year and charged Carl with making the death threat and me with theft. And also their collar numbers please.
Could you please also explain what the reason is for not pressing charges on Carl this time? The incidents last year were in August and we were both advised that any further infractions would result in police action/investigation and the previous incident would be raised again. It seems that is not the case so Iâd like a clear explanation as to why not.

I am so sorry you have not been up dated but a Police Officer took over the incident and the case was taken on by them.
They have visited Sandwell Council House and spoke with the ASB Officer who has previous knowledge of the dispute.
He will be conducting an investigation with the possibility of asking you and your neighbour to attend the council house for a mediation session.

I have replanted herbs and wild flowers but I am concerned that Carl will just rip them out again. Can you please update me on what action, if any has been taken following the incidents I reported.
As I stated when you visited, he ripped out my plants and threw them in the bin, which according to the officers that dealt with us both last year, is theft. I am reiterating that I want to press charges for this as he has gotten away with this too many times before.
He has also harassed me about my mental health. Iâm reasonably sure if I mocked him for being deaf or autistic there would be consequences. When I try to work on the gardens I get chased off, but they are all communal gardens meant to be enjoyed by all of us who live here not just the privileged few.
If you are not willing to take any action could you please confirm that in writing?

Hi Gina,
Carl has ripped a bunch of my plants out of the communal gardens again. I canât work on the garden or he gets aggressive and threatens me, but I do tend to grab some herbs when I need them as it only takes 30 seconds. However Carl has ripped out every plant I put in the communal gardens without warning, explanation or apology.

Hi Gina,
I have replanted herbs and wild flowers but I am concerned that Carl will just rip them out again. Can you please update me on what action, if any has been taken following the incidents I reported.
As I stated when you visited, he ripped out my plants and threw them in the bin, which according to the officers that dealt with us both last year, is theft. I am reiterating that I want to press charges for this as he has gotten away with this too many times before.
He has also harassed me about my mental health. Iâm reasonably sure if I mocked him for being deaf or autistic there would be consequences. When I try to work on the gardens I get chased off, but they are all communal gardens meant to be enjoyed by all of us who live here not just the privileged few.
If you are not willing to take any action could you please confirm that in writing?

I was wondering if you have an update on the plan going forward? Also, I found some details of the other incident I mentioned, on the stairs. DC Meadows 14th September 2016, Maduagwu.
My nephews parents are livid having seen the footage and Carl snatching a toy from the 3 year old and throwing it in the bin then hustling him inside (I wasnât aware of that until viewing the footage myself as Oscar is too young to communicate that effectively.) The older boy, Aiden is scared of âthe evil man upstairsâ constantly warning guests which indicates the incident is on his mind. Aiden wonât even take the rubbish down without me with him now, something he was proud to do as a âchoreâ since he turned 5.
Council (Jennifer) said if one of my guests hits Carl in retaliation it would get me in trouble as they are my responsibility, but the father is hot headed and if Carl goes near my nephews again I doubt Iâll be able to convince him to stay away. As it is I wonât let him visit the boys here anymore to avoid trouble.
The footage clearly shows Carl was already outside when the boys went out to play and it was Carl who called to the kids and approached them, they did not startle him on the stairs or while he was holding a basket of clothes as he claimed. I also assume you have now been able to verify the amount of time between Carl making the death threat, my call to the police and my kicking him only when he came at me?

As it is I wonât let him visit the boys here anymore to avoid trouble.
The footage clearly shows Carl was already outside when the boys went out to play and it was Carl who called to the kids and approached them, they did not startle him on the stairs or while he was holding a basket of clothes as he claimed. I also assume you have now been able to verify the amount of time between Carl making the death threat, my call to the police and my kicking him only when he came at me?

Hello,
yesterday I submitted ASB 48618 because Carl has once again ripped my plants out. I weeded the flower beds at the weekend and filmed the whole thing using multiple cameras in the windows and my mobile and tablet as Nik advised.
Carl came out several times and stood glowering a few times and went into number 30 a few times where I could hear them all talking about the gardens and me. Then Carl came out in a communicative mood and we talked and he said he wanted to put Roses in the bed. I said the Wild flowers are short and Roses are tall so there's no reason both can't go together. I asked him to fix that monstrosity of a gate that no one has removed despite requests and emails. Yesterday Carl went out and ripped out an entire flowerbed of wild flowers. Not a random flowerbed but the exact flower bed of wild flowers we discussed at the weekend. On video (thanks for the tip - I used an Amazon Kindle)
Now I'm mad enough to go down there and rip all his damned roses out myself. And when I say Mad I mean I-want-to-punch-his-face-in-angry. The only positive thing is this time I have a witness that may surprise you. Gina Birch, when you chatted with him and he looked so cheerful he was destroying the ONLY patch of wildflowers left in the gardens. The wild flowers he complained about on video and I defended and said were lovely and are little so won't stop roses growing above them.
Now I'm angry enough to handle this myself and make sure Carl has a consequence for his action because I am still limping after his attack last August. So if you all don't want to do anything about him then leave him to me and I'll happily take care of things myself this time. But fairs fair, I've just done 6 months of physiotherapy because of that man and still have pain daily due to my hip. So if I put him in hospital remember this crap has been going on since 2010 when I moved in and I have a LOT of anger to vent, and 9 years of revenge hitting, smacking, swinging sticks at his head (metal poles would be preferable but sadly after his attack I removed them all and took them to the tip.) I am desperately trying to reign in my anger and leave it for the professionals to sort out but after the farce last August of making sure I made the complaint properly to the council and police and waiting weeks following up with the help of Eve and Sylvia only to be told just hours after signing a good neighbour agreement that the police are not taking action against the man who left me with a hip that constantly hurts when I walk to far, bend, twist or stretch and left me having to try to find the money to get taxis to physiotherapy when I had only £65 a week to live on.
I am gritting my teeth and holding my temper in, reporting it to the relevant authorities and waiting for you to do something. I am also awaiting action on the electricity problem which has been reported but continues. If even one of my electrical items is damaged by one of these power cuts I can't guarantee I'll not lose my temper with the person at the cupboard when the power goes out.
The challenge for me right now is that I am incredibly angry, not just because my flowers have been ripped out again, but because this is the tip of a pyramid that is huge. Nine years of having my plants ripped out but trying to hold my temper. Nine years of him getting away with ripping out my plants despite CCTV evidence that wasn't cheap to get, multiple complaints, mediation etc. Nine years of him hitting me, shoving me and not having any consequences for his actions.
Please treat him like all other tenants that break the rules. The communal landings are a fire hazard but despite ASB complaints the stuff is still there. There's firewood being stored in the bin area. Dangerous items on the shelves he has put in the communal areas. Coal in the electricity isolation cupboard. Everywhere I look Carls crap is surrounding us and nothing is being done to clean it up.
So this is a request not only to ask you to deal with the above ASB complaint, but it's probably time to acknowledge that removing everything from the communal areas is the only way this is going to be resolved permanently. This is a block of six flats but despite all efforts there are still only two households able to enjoy the communal areas, time to put a stop to that once and for all.
Also, as he has done this after signing the good neighbour agreement does that mean you can finally evict him?

Hi Gina,
Hoping you can help. Yesterday my nephews (aged 3 and 6) were playing in the communal gardens with my friends kids (aged 6 and 8) when Carl came and shouted at them, terrifying them and chased them back into the building as they âare not allowed to play in his garden.â They had scooters, footballs and chalk, nothing noisy. When my friend and I went down to challenge him and warn him to stay away from the children he shouted at my friend telling her he has lived here for 37 years. She and I donât care how long he has lived here, he has no right to go anywhere near my nephews or my friends children, or for the matter the little boy who has the misfortune to live in this building but canât play outside.
Carl then went inside and fetched some water and a broom and started cleaning up the kids chalk whilst they were still trying to play under our supervision, so my friend and I defended the children and chalked on the floor âwe can play in this garden and if the bad man comes back we will tell Marieâ to make it clear to the kids and to Carl that the kids are welcome to play and Carl has no right to chase them off. It Is laughable that he felt compelled to fetch water and clean up chalk when he continues to store dangerous items in all communal spaces. There is still a pile of iron bars in the front garden, wood with nails in it in the front and back gardens and on the communal landing. He has used the iron bars in the front garden as a weapon against me when I was down there maintaining the garden and weeding (video is on Youtube) but he has not maintained the garden for a year now. So if anyone else tries to tidy it up he goes ballistic, but he wonât tidy it himself.
As a result of yesterday friends are going to join me to help clean the communal spaces to make them tidy, and most importantlyâ¦. Safe. But the fathers of both sets of boys are ready to come and beat Carl to a pulp for scaring their young kids, I am hoping you can help avoid this by making him understand once and for all that he cannot go around shouting at people, does now own this garden or any other property and needs to stay the hell away from me, my guests and children he doesnât know?
Reported officially to council and police on 111 but my nephews regularly stay with me and are now terrified. They are due this coming Friday and I need to be sure Carl will stay away from them.

Hi Gina,
I took legal advice and initiated a âCommunity Triggerâ Iâm now liaising with Nick Woolridge who oversees Tipton area for Sandwell Council.
I have also contacted my MP who has asked me to send him all my correspondence, CCTV footage etc. But I need the names of the two officers who investigated last year and charged Carl with making the death threat and me with theft. And also their collar numbers please.
Could you please also explain what the reason is for not pressing charges on Carl this time? The incidents last year were in August and we were both advised that any further infractions would result in police action/investigation and the previous incident would be raised again. It seems that is not the case so Iâd like a clear explanation as to why not.

They have visited Sandwell Council House and spoke with the ASB Officer who has previous knowledge of the dispute.

I have replanted herbs and wild flowers but I am concerned that Carl will just rip them out again. Can you please update me on what action, if any has been taken following the incidents I reported.
As I stated when you visited, he ripped out my plants and threw them in the bin, which according to the officers that dealt with us both last year, is theft. I am reiterating that I want to press charges for this as he has gotten away with this too many times before.
He has also harassed me about my mental health. Iâm reasonably sure if I mocked him for being deaf or autistic there would be consequences. When I try to work on the gardens I get chased off, but they are all communal gardens meant to be enjoyed by all of us who live here not just the privileged few.
If you are not willing to take any action could you please confirm that in writing?

Hi Gina,
CCTV footage downloaded. The balcony camera (front garden) is pretty much a bust you can see glimpses of everyone as we wealk back and forth/sit on the wall, but cannot see the path due to Porch roof. I saved it anyway. The rear camera has plenty.
Timeline 26/08/2017
13:24 Nephew assists me putting trash in bin and stays downstairs to play on scooter.
13:27 He comes back inside to use toilet and fetch little brother.
13:45 Both boys come down to play with scooters, balls, a treasure map, and chalk.
13:55 Clear up toys and bring them back upstairs.
16:05 Carl comes down with armful of clothes, rubs at chalk with his foot, goes to far side of garden (presumably hanging laundry on line but this is off camera so that is just speculation.)
16:09 Boys come outside with friends (4 children in all) Carl immediately comes around and approaches boys pointing at chalk and gesticulating at them. Boys back off, one comes back upstairs (8 year old), the other 3 stay on the side of garden by my motorbike. Carl spends the next 10 minutes going back and forth with laundry.
16:18 Carl comes around to boys gesticulating at 3 and 6 year olds (who back off again,) and at chalk. He then shoos them inside and picks up football following boys inside.
16:20 Carl comes back down with soap and broom.
16:21 I come down and go mad at him for scaring kids and for bothering them in communal garden etc.
He is off camera but this is when he was cleaning hopscotch as they tried to play.
16:24 Other boys mother tries talking to Carl. We both remain downstairs playing with children to make it clear it is ok for them to play there.
I canât see any point where they were inside/on staircase to startle him. They stayed away and he came around to where they were playing to get them out of the communal gardens. All downloaded and backed up. I can post on youtube and send you link or burn it onto a dvd for you.

Hi Gina,
I have replanted herbs and wild flowers but I am concerned that Carl will just rip them out again. Can you please update me on what action, if any has been taken following the incidents I reported.
As I stated when you visited, he ripped out my plants and threw them in the bin, which according to the officers that dealt with us both last year, is theft. I am reiterating that I want to press charges for this as he has gotten away with this too many times before.
He has also harassed me about my mental health. Iâm reasonably sure if I mocked him for being deaf or autistic there would be consequences. When I try to work on the gardens I get chased off, but they are all communal gardens meant to be enjoyed by all of us who live here not just the privileged few.
If you are not willing to take any action could you please confirm that in writing?

Dates and logs I can find, I have more paperwork to go through at some point but these are most of them. Council also have a large file on this with additional incidents not reported to police. If you need those I can sign authority if itâs needed.
Bad calendar notes.
15/05/2012 log number 1206 (I canât remember what this was for â memory problem = disability which is why I struggle to recall dates. I saved it on my calendar so clearly important. May not be related to Carl.)
08/01/2013 â Police came between 4 and 5pm for appointment, but again no notes on incident to indicate if it was about Carl.
29/01/2013 â tried to force his way into my flat. Canât find ref number but definitely reported immediately.
04/02/2013 Police log number 571 May not be about Carl, calendar just has log number and itâs too long ago for me to have a clue.
Calendar notes get better, probably because I realised I would need to keep referring to them.
15/04/2015 â harassed young person staying with me and chased him out of garden (2243 15/04/2015)
16/04/2015 â put padlock on communal gate, council and police sorted it out and explained it is not his garden. (593 16/04/2015) Whilst police and council were here he was aggressive towards me and PC Ross and Dawn council employee witnessed it plus PC Ross stepped between us and walked towards CC making him back up away from me.
23/02/2016 â Shoved me to get me away from neighbours door. I had a card telling me that neighbour had taken in a parcel for me and was trying to retrieve my parcel. 1630 23/02/2016 Stated I wanted to press charges but told nothing police can do because he is tenant in same building so council need to deal with him. Advised about pre-emptive strike if I am feeling threatened and cctv recommended.
Installed CCTV.
14/05/2016 â Ripped out tree I planted in communal garden (1256 14/05/2016)
Staircase incident where he shoved/pushed and I hit my head on concrete. (canât find date but it was definitely reported. Winter 2015/Spring 2016.
I was also given the advice on attached paper, this was last year either after the shoving incident when I was by neighbours door or when he shoved me and I hit my head when on stairs. Iâm sorry I canât remember which one it was but Iâm hoping it can help you narrow it down.
If you need more info please let me know.

I took legal advice and initiated a âCommunity Triggerâ Iâm now liaising with Nick Woolridge who oversees Tipton area for Sandwell Council.
I have also contacted my MP who has asked me to send him all my correspondence, CCTV footage etc. But I need the names of the two officers who investigated last year and charged Carl with making the death threat and me with theft. And also their collar numbers please.
Could you please also explain what the reason is for not pressing charges on Carl this time? The incidents last year were in August and we were both advised that any further infractions would result in police action/investigation and the previous incident would be raised again. It seems that is not the case so Iâd like a clear explanation as to why not.

I have replanted herbs and wild flowers but I am concerned that Carl will just rip them out again. Can you please update me on what action, if any has been taken following the incidents I reported.
As I stated when you visited, he ripped out my plants and threw them in the bin, which according to the officers that dealt with us both last year, is theft. I am reiterating that I want to press charges for this as he has gotten away with this too many times before.
He has also harassed me about my mental health. Iâm reasonably sure if I mocked him for being deaf or autistic there would be consequences. When I try to work on the gardens I get chased off, but they are all communal gardens meant to be enjoyed by all of us who live here not just the privileged few.
