This risk was foreseeable given my injury, fatigue, and the inaccessibility of my bungalow. I have since required multiple emergency and urgent care interventions to meet basic activities of daily living safely. Community alarm staff have attended and recorded safeguarding concerns. I am currently receiving short-term support from the STAR team, who are attending multiple times per day to assist me to toilet safely. These constraints have been documented repeatedly by previous Occupational Therapists and Housing Officers over several years. Dear Ali, I am following up on my previous request for a copy of the Care Needs Assessment completed on 6 January 2026. I have not yet received it despite multiple written and text requests. Since that assessment: • No one has attended to bolt down the toilet frame. • I am having to hold urine and bowel movements for up to ten hours between calls or request emergency response assistance to avoid falling. • My health is being impacted by dehydration and bowel retention as a direct consequence. • The STAR Team have been attending four times daily since 23 January 2026 to act as human grab rails following my injured elbow on 22 January 2026. This is not an appropriate long-term solution for a bathroom that is not wheelchair accessible, in a bungalow and garden that are also not wheelchair accessible. I have been informed that attempts by the Community Alarm Team to raise safeguarding concerns have again been blocked by Adrian Scarrott and colleagues. I am also aware that a response from James McLaughlin regarding earlier escalation is now over a year overdue. I have a medico-legal assessment on 24 February 2026 relating to my fall on 5 December 2022 and all subsequent documented falls and injuries. I require the 6 January 2026 assessment for inclusion in my evidence bundle. Please confirm when I will receive a full copy. I require it no later than 17 February 2026. Dear all, I am forwarding my recent email to Ali Asghar regarding my Care Needs Assessment (6 January 2026) and ongoing safeguarding concerns. I am now formally requesting that you liaise directly with one another regarding my current circumstances. I am experiencing significant burnout and am no longer able to continue translating information between services. At present: • I do not have an agreed copy of my Care Needs Assessment. • I am managing ongoing fall risk and impaired mobility following injury. • I cannot self-propel my wheelchair reliably. • I am reliant on limited support (2 hours per week via The Gables since 27 January 2026). • I am unable to access housing payments or disability easements to stabilise Universal Credit issues. • I am facing council tax court proceedings and debt collection despite long-standing requests for floating support. • I am simultaneously navigating criminal proceedings, ADHD and autism assessments, safeguarding concerns, and housing inaccessibility. I am currently putting in 40+ hours per week in life administration simply to remain afloat. This is not sustainable. Each of you is professionally positioned to address part of this situation. However, without coordinated communication between agencies, I remain stuck without the correct paperwork, shared understanding, or aligned action. I am therefore requesting: Confirmation of who is taking lead professional responsibility. A coordinated case discussion (virtual is fine). Clear written confirmation of actions, timescales, and information sharing. Please treat this as a request for multi-agency coordination due to cumulative risk, not as individual correspondence. Formal response to Outcome Focused Assessment – factual corrections and safeguarding concerns Dear Ali, Thank you for sending the completed Outcome Focused Assessment. I am providing the following corrections to ensure my record is accurate. Managing Toilet Needs The assessment states that I am unable to manage toilet needs without assistance. This is factually incorrect. I am able to use accessible toilets independently in the community and in friends’ homes. In smaller bathrooms (under 1m width), I am able to brace safely against opposing walls, which provides stability. Since 2020, only four falls have occurred outside 8 Boldmere Court. The consistent pattern is that falls occur within my bungalow due to the bathroom layout and spatial constraints. The issue is environmental, not functional incapacity. The bathroom measures approximately 1.9m x 2.2m. For a wheelchair user, Building Regulations guidance indicates approximately 2.5m x 2.5m is required for safe manoeuvre and lateral transfers. The current space is insufficient. A bolted toilet frame would not resolve the issue. The previous frame obstructed access to the basin for approximately five years. What is required is either: • Properly installed drop-down grab rails that can be raised to allow wheelchair access to the basin without obstruction or • Rehousing to accessible accommodation. Falls Falls have been ongoing since 2020 at Boldmere Court. The only significant reduction in falls occurred during the 18 months I lived away from the bungalow in Cornwall, where I had access to a safe and appropriately configured bathroom. Falls in the back garden reduced after summer 2023 because I stopped using the garden following a 10-day hospital admission for concussion. Falls on the toilet have been repeatedly reported since I moved in. The cause has consistently been identified as the space and layout. The assessment questions whether I should be able to self-transfer based on observed transfers. I note that you are not an Occupational Therapist specialising in spinal cord injury or wheelchair biomechanics, nor have you assessed me using the toilet. Qualified OTs have confirmed that in an accessible space I am safe to toilet independently. Current Care Package The current Star team care package was implemented more than two weeks after your initial visit, following a preventable fall. It was not proactive risk mitigation. The 7am call that was discussed to reduce overnight bowel delay was not implemented. Instead, morning calls were scheduled later, increasing the gap between toilet access and directly increasing risk. This preceded my fall at 9:10am. Needs at the Bungalow My needs have never been met at Boldmere Court. The reduction in incidents outside the property demonstrates this clearly. The environment is the variable. Motivation Framing My motivation is safe housing as discussed with James McLaughlin. Litigation has arisen because statutory duties as landlord and social care provider have not been met over a prolonged period. I have made reasonable adjustment requests for approximately 15 years. The difference now is that I have greater knowledge and vocabulary to articulate them effectively. This is not evidence-gathering behaviour. It is sustained self-advocacy. Mental Health Context Historical NHS misdiagnoses and Section 136 involvement must be viewed in context: • 2009: Ovarian cyst misdiagnosis leading to loss of employment and housing. • 2010: Property left insecure for four months despite repeated contact. • 2010–2018: Harassment at Groveland Road, including death threats and assault leading to spinal cord injury. • Repeated challenges in writing to personality disorder diagnosis, with letters documenting autistic and ADHD traits from 2012 onwards. Being given incorrect treatment pathways is not evidence of unreliability. It is evidence of systemic diagnostic failure. Kitchen The kitchen fire occurred in the context of unsafe support and environmental breakdown. The council took approximately 18 months before ordering replacement works and paused at the ripping out stage in March 2025. Concerns about the unsafe kitchen were raised from January 2022 onwards. West Midlands Fire Service intervention occurred in November 2022. My cooker was disconnected by SMBC and replaced with a temporary tabletop solution which I am still using. I currently require: • A sink with hot and cold running water • Knee clearance beneath worktops • A safe, accessible cooker and hob • Proper counters rather than improvised dining-table solutions The current configuration was self-built without SMBC support as shown in photos. Risk Level Recording my risk level as “Low” is incompatible with: • Recurrent falls linked to bathroom layout • Hospital admissions • Interim four-call-per-day care • Ongoing absence of essential adaptations This requires review. Care Charges Care charges require a financial assessment. My income is: • £340 Universal Credit per month • £740 PIP every four weeks No housing benefit, council tax reduction or disability premiums currently in payment. This remains outstanding from the 2023 MDT discussions. I request that the above corrections are formally appended to my record. I remain willing to engage constructively in developing a long-term support plan that addresses environmental risk rather than reframing it as personal unreliability. Before confirming any further visit, I need clarity on its purpose, as the feasibility issues with this property have already been extensively assessed and recorded.

For avoidance of doubt:

• The bathroom measures approximately 1.9m x 2.2m and is too small to be made wheelchair accessible.
• The walls are not reinforced, meaning grab rails cannot be safely fitted.
• The rear door does not allow for an external wheelchair turning circle due to the fixed fence line; the available width is approximately 80cm.
• The entrance hall is too narrow and obstructed, preventing safe wheelchair circulation.

These constraints have been documented repeatedly by previous Occupational Therapists and Housing Officers over several years.

Given that these are fixed structural limitations, please can you explain:

1. What new information, authority, or funding would this proposed visit introduce that has not already been considered?
2. How the attendance of the Assets team would change the established conclusion that the bathroom cannot be made accessible within the existing footprint?
3. Whether this visit is intended to progress an alternative solution (e.g. re-housing, structural reconfiguration, or formal acknowledgment of non-adaptability), rather than re-inspecting known constraints.

Without a clear explanation of how this visit would lead to a materially different outcome, it is difficult for me to see how another inspection is a reasonable or proportionate use of time, particularly given the ongoing safety risks and my current health limitations.

I am happy to consider next steps once the above is clarified in writing.

I am writing to note, again, the absence of any substantive response from you or your office despite extensive correspondence, evidence, and repeated opportunities to engage constructively.

For clarity: I currently have no practical ability to go outside or live independently in my home due to unresolved accessibility and safeguarding failures. As a result, I have time, capacity, and patience. I am calm, regulated, and methodical. Please do not mistake this for disengagement.

I am also conscious that there appears to have been an assumption, common but incorrect, that a disabled person who is overwhelmed, distressed, or navigating trauma is somehow confused, unreliable, or incapable of understanding systems and accountability.

Good morning Shokat,
I am writing following yet another fall in my bathroom at around 4am this morning, caused by the instability of the temporary toilet frame I have been forced to rely on for over five years. This is not an isolated incident. It is part of a well-documented pattern of avoidable risk created by Sandwell MBC’s continued failure to provide basic, legally required accessibility adaptations.
This morning a technician attended to address a “wobbly sink” and was visibly shocked to discover that there is no sink at all, and that five years after moving in, my home has still not been made wheelchair-accessible. The kitchen layout was unsafe, the cooker placement increased risk, and the only adaptations present are piecemeal NHS-installed grab rails and door strips. This is not compliance with housing or equality law. It is a danger zone.
I was also contacted by the community alarm provider, who advised that my “free” period is ending and that I should now begin paying, despite the fact that they are attending multiple times per week because my home environment is unsafe. Charging me for emergency responses created by Sandwell’s failure to adapt my home is not ethical, and their call-out records will form part of the evidence trail.
For the avoidance of doubt, I hold a large body of contemporaneous evidence showing that senior officers were aware of the risks, the trauma I experienced at Manifoldia Grange, and the urgent need to resolve my housing situation. This includes:

Apologies and commitments from the Assistant CEO acknowledging the harm caused

Advocacy correspondence reminding senior leadership of their responsibilities

Evidence that I was sent back to Manifoldia Grange despite it being known to be unsafe and traumatising

I have also submitted a formal complaint about the Assistant CEO to the Chief Executive. I have yet to receive a response.
I am now properly supported around my neurodivergence (Autism and ADHD) and trauma, and I am calmly, methodically documenting every interaction with Sandwell staff. This includes care needs assessments, visits, phone calls, and the repeated failure to issue paperwork or implement agreed support. The pattern is already clear.
I am not asking for special treatment. I am asking for what the law already requires:
A safe, accessible home and a small amount of practical support (around 3–4 hours twice a week) so that I can live independently and safely.
To everyone copied into this email:
Please look at the evidence I am publishing and storing, including my public record of events. Ask yourselves whether silence and internal loyalty matter more than basic safety, legality, and human dignity. Whistleblowing, safeguarding escalation, or simply telling the truth internally could prevent further harm.
This situation will not quietly go away. It will either be resolved properly now, or it will be examined later by Ombudsmen, regulators, and the courts with the benefit of a full documentary trail.
I remain willing to work with anyone inside Sandwell MBC who has the integrity and authority to actually fix this and now that I am AWARE of the flavour of my neurospiciness I'm once again a happy little nerd, able to self regulate like a champ and sending sensible emails like this after a fall instead of angry outbursts and threats ;)

Dear Ministry of Housing,
I am writing in relation to your previous response TO2025/10962 dated 29 April 2025, which advised me to pursue my concerns through Sandwell Metropolitan Borough Council, up to and including the Chief Executive, and then the Local Government Ombudsman. TO2025_10962_Response
I need to make clear that this advice is no longer workable, because the Chief Executive of Sandwell MBC is directly part of the complaint pathway that has failed. The local authority has repeatedly failed to provide safe, accessible and compliant housing despite clear disability-related needs and safeguarding concerns.
This is no longer an individual housing dispute. It is a potential failure of a regulated local authority to comply with national law, including:
– Equality Act 2010 (reasonable adjustments and discrimination)
– Building Regulations Part M (wheelchair-accessible dwellings)
– Social housing standards and safeguarding duties
I have attached photographic evidence of my home showing non-compliant access, unsafe bathroom and kitchen arrangements, and environmental hazards. These are not matters of preference; they are matters of safety and legal compliance.
I am asking the Ministry to treat this as a regulatory and governance issue, not a request for rehousing. When a council’s own senior leadership is part of the failed complaints loop, the “go back to the council” route is no longer an adequate remedy.

Good morning Shokat,
I am writing following yet another fall in my bathroom at around 4am this morning, caused by the instability of the temporary toilet frame I have been forced to rely on for over five years. This is not an isolated incident. It is part of a well-documented pattern of avoidable risk created by Sandwell MBC’s continued failure to provide basic, legally required accessibility adaptations.
This morning a technician attended to address a “wobbly sink” and was visibly shocked to discover that there is no sink at all, and that five years after moving in, my home has still not been made wheelchair-accessible. The kitchen layout was unsafe, the cooker placement increased risk, and the only adaptations present are piecemeal NHS-installed grab rails and door strips. This is not compliance with housing or equality law. It is a danger zone.
I was also contacted by the community alarm provider, who advised that my “free” period is ending and that I should now begin paying, despite the fact that they are attending multiple times per week because my home environment is unsafe. Charging me for emergency responses created by Sandwell’s failure to adapt my home is not ethical, and their call-out records will form part of the evidence trail.
For the avoidance of doubt, I hold a large body of contemporaneous evidence showing that senior officers were aware of the risks, the trauma I experienced at Manifoldia Grange, and the urgent need to resolve my housing situation. This includes:

Apologies and commitments from the Assistant CEO acknowledging the harm caused

Advocacy correspondence reminding senior leadership of their responsibilities
  *
Evidence that I was sent back to Manifoldia Grange despite it being known to be unsafe and traumatising

I have also submitted a formal complaint about the Assistant CEO to the Chief Executive. I have yet to receive a response.
I am now properly supported around my neurodivergence (Autism and ADHD) and trauma, and I am calmly, methodically documenting every interaction with Sandwell staff. This includes care needs assessments, visits, phone calls, and the repeated failure to issue paperwork or implement agreed support. The pattern is already clear.
I am not asking for special treatment. I am asking for what the law already requires:
A safe, accessible home and a small amount of practical support (around 3–4 hours twice a week) so that I can live independently and safely.
To everyone copied into this email:
Please look at the evidence I am publishing and storing, including my public record of events. Ask yourselves whether silence and internal loyalty matter more than basic safety, legality, and human dignity. Whistleblowing, safeguarding escalation, or simply telling the truth internally could prevent further harm.
This situation will not quietly go away. It will either be resolved properly now, or it will be examined later by Ombudsmen, regulators, and the courts with the benefit of a full documentary trail.
I remain willing to work with anyone inside Sandwell MBC who has the integrity and authority to actually fix this and now that I am AWARE of the flavour of my neurospiciness I'm once again a happy little nerd, able to self regulate like a champ and sending sensible emails like this after a fall instead of angry outbursts and threats ;)

Dear STAR Team and Community Alarm Team,

Thank you for the daily support you continue to provide following repeated falls. You see the risk firsthand.

For transparency, I am forwarding the year old apology from James McLaughlin and his response to Community Offer/StAlbans several months later.

I am asking that this matter now be escalated to senior managers across services because the underlying risks remain unresolved. Social media links in footer contain relevant media.

Summary of key events since January:
• 6 January 2026 – Simon Wilson (Floating Support) stated there were no issues he could assist with and refused the service.
• Ongoing – No housing element payments from Universal Credit since Spring 2024 despite rent liability at Manifoldia Grange and previously Boldmere Court. Rent arrears texts regularly received yet no support to access UC Housing payments.
• 13 September 2025 – Discharged from Rowley Regis Hospital.
Discharge team reportedly informed by Housing Officer Janet Millet that SMBC would not install grab rails, ramp, or agreed adaptations.
• Post-discharge – Due to lack of adaptations and fall risk in the bungalow, I lived in my car for approximately six weeks to avoid further injury.

This was safer than remaining inside the property.

• Ongoing – Repeated falls in the bungalow environment, which your teams continue to attend.

Senior leadership including Adrian Scarrott, Vince McCalla, Elaine Oxley, Alan Lunt, Cllr Jackie Taylor, James McLaughlin and Shokat Lal, Kerrie Carmichael and Steve Melia, Safeguarding etc. have been notified multiple times over an extended period.

Despite this, adaptations approved in 2021 and reviewed in 2023 remain uninstalled.

I am requesting:
Formal escalation to senior operational managers across Housing, Adult Social Care and Safeguarding with robust follow up to challenge their inaction and non-response.

A joint multi-agency review of discharge decision-making and current environmental risk with:

Written confirmation of who currently owns risk responsibility for the unsafe bathroom, lack of grab rails, and access adaptations.

The current situation is generating avoidable falls and avoidable emergency call-outs.

I recently tried to reach out to departments to try to resolve issues but one of the first responses I received was from Beverly about the care charges, given the volume of emails between us over the last 5 years with me requesting support to submit my budget for a fair assessment based on my income and expenditure, and Bev repeatedly using figures from 2018/2019 because I failed to access support to provide up to date figures.

Thank you for your response I understand the limitations on your time and appreciate your acknowledgement of my email



I removed the bungalow from the timeline because I was advised that it complicated the discrimination issue but I have everything collated and would welcome time to meet and discuss my concerns in full so you can look into the matter.



I can travel up to meet at the council house in Oldbury or any other SMBC building any time to suit you after Tuesday 28th January, but I need a couple of days notice so I can rest the day before I drive up.



I'm facing sleeping in my car from Feb 1st as the caravan and campsite are both unaffordable at present so this has been very stressful and my MH has been fragile trying to resolve significant challenges to day to day life hence my delayed response.



I accept it will take some time after our meeting for you to look into my concerns and gather the information you'll need to respond and so request we meet as soon as you are able to to begin the process.



I have delayed making a decision on terminating the tenancy because I've been advised this is not in my best interest and so I'm waiting for MH assessments to determine both what my diagnosis is and what support is appropriate. Only once I have appropriate support can any long term decisions be made.

An update



I am suing SMBC for a fall I had on 5th December in one of their properties and the SMBC solicitor originally came back stating I had not informed SMBC that I needed a wheelchair at that point.



Correspondence proved not only were SMBC informed that I needed a wheelchair but also that this was because my neighbour damaged my spine and SMBC only made him write me a letter of apology. SMBC solicitors are settling that claim on a no prejudice basis.



Yesterday I saw the medici legal solicitor and he is referring me for an assessment with a neuropsychiatrist because he thinks I have a brain injury as well as trauma.



I have years of correspondence showing I've been describing my communication issues and begging for help but SMBC staff have consistently ignored my human rights to a safe home and staff as senior as the deputy exec just ignore these emails.



I was normal when I moved into my first SMBC property in 2010 and tried to buy the property in 2017ish but living there being harassed non stop by Carl Clift broke me mentally and his five assaults left me physically disabled. The discrimination I experienced throughout that tenancy by Tipton asb team was appalling so when I moved out of Tipton my mental and physical disabilities were well documented.



I moved to an SMBC owned wheelchair accessible bungalow in November 2020 but it is still unsafe for wheelchair users and I can't live there having falls every week because my landlord won't fit a ramp being poisoned and starved by carers provided by SMBC because the kitchen is too unsafe for me to cook in independently not because I'm not capable of cooking for myself.



I agreed to terminate the tenancy but a payment from SMBC to help cover the camp site fees was not received as agreed and I was not able to travel up on 1st January as planned. I am a disabled SMBC tenant who is living in a caravan because her wheelchair accessible bungalow is unsafe 4 years after I moved to it, my support worker describes SMBC as the worst local authority she has ever dealt with as she's been trying to get legally required adaptations for two years without success and has also experienced SMBC staff ignoring required time frames etc.



I could go cripple Carl, write him a letter of apology explaining I really didn't want to hurt him, I'm a pacifist who believes violence doesn't solve problems however I believe the treatment I experienced at the hands of SMBC staff was wrong and it feels like the only way to highlight this is to do unto others as they have done to me. So if I cripple him I can sit back and watch as HE asks for his flat to be adapted for a wheelchair so he doesn't have to move out of his home. If he asks for carers to feed him 3x daily I can explain no he only gets 2x meals per day, if he asks for a wheelchair accessible bungalow I can point out SMBC don't provide safe homes for their disabled tenants and then he gets angry about how he's being treated and sends an angry email to the staff responsible I'll expect SMBC to threaten him with eviction for a breach of tenancy rather than address the problem.



As I lose this caravan at the end of the month and will be sleeping in my car I really have nothing left to lose. The above legal action can't happen soon enough to help me avoid homelessness because I can't access universal credit or resolve SMBC issues when even the assistant chief exec.  I can't access the help I need to access the help I need! It's ridiculous and I'm out of patience.



A jail cell would be a lot easier and comfier than a caravan so that's the timeframe for someone to contact me to discuss the above and seek meaningful resolutions, I'm unwilling to live like this any more.



I'll write the letter of apology to Carl so I can leave it with him after I take revenge, I will limit my attack to ensure his injuries match the injuries he inflicted on me. Broken toe, concussion and a spinal cord injury. I'll use them iron bars he swung at my head, I assume Carl is still allowed to hoard rubbish and dangerous items in the communal areas and I'll find the iron bars on the front garden where he kept them.



I'm not in crisis, I'm following SMBC logic which implies that it's fine for people to cripple each other, this doesn't require police or court intervention but simply a letter of apology to make ten years of abuse go away.



And James I'm going to send you a personal letter before court. As the highest level member of staff to ignore me when I worked really hard to express the problems calmly and clearly, I feel that you are setting a poor example for your staff and if that content was received from any other tenant you would have responded to it. I tire of this poor treatment and remind you that as my landlord SMBC has a duty of care to me, universal credit paid rent for an uninhabitable property leaving me without the financial support I need and I am facing sleeping in my car because of the problems with SMBC.



I met west Midlands fire service at the property on Saturday and explained to them I need to return to it at the end of the month, SMBC have had over 15 months to make the kitchen SAFE by moving the cooker away from the door which was meant to take 6 to 8 weeks, enough is enough.



Either Carl faces legal consequences for the harm he did me and that process begins immediately or I do to him what he did to me (nothing more nothing less) and watch SMBC reaction pointing out any differences in the SMBC approach to him afterwards.

Thank you for your prompt response to my enquiry below.  Regrettably James has not followed up and my circumstances have changes in the interim, my entire Team was made redundant at the end of last month.  As a direct result of my inability to communicate effectively with your colleagues my day to day life is impacted in the following ways:

  *   I am currently unable to access financial support from Universal Credit for housing costs because my permanent address remains 8 Boldmere Court, B43 5PH until someone from Sandwell MBC either repairs the property so it is safe for me to return to it to sell my possessions and terminate the tenancy or cancels the job and allow me to return to empty the property of my possessions and terminate the tenancy.  Work was scheduled to take 6 to 8 weeks in September 2023 but no date for the work to commence has been provided and a Stage 2 complaint submitted by an advocate is now 4 months overdue its final response from Lisa Ellis (who has been trying to get answers but is equally unable to.)

  *   I am unable to receive mail on campsites which were meant to be a temporary solution for the 6 to 8 weeks the repairs were meant to take, this causes additional challenges for example I had to attend Bodmin Court last month to address a speeding ticket that had already progressed to court action before I was aware of it.  The fine paperwork was sent to the bungalow so I am trying to address this as I am now being prosecuted for failing to make the first payment towards the fine because I lack the information I need to do so.

  *   Because I'm unable to update my permanent address I am also unable to access many services locally, book online delivery unless a pick up location is offered, receive my medication much is mail delivery and many other simple functions always having to find a work around.

  *   I am being threatened with court action by SMBC to collect Care Charges that were unfairly assessed and requests for support to complete the assessments with accurate information were and still are being ignored, these could have been addressed back in 2019, 2020, 2022 and 2023 if appropriate support to submit the required paperwork had been provided as requested, recent attempts to work with this department have been ignored.

  *   My MH diagnosis is currently being reassessed query Neurodivergency or Trauma but whether my MH issue was caused by my experiences in Tipton (Trauma) and trying to communicate with SMBC staff about the issues or Neurodivergency or the diagnosed Personality Disorder, the lack of appropriate support for my inability to communicate effectively with SMBC has been well documented, as have my hundreds of pleas for help to multiple SMBC departments and staff.  I am treated either as a capable person who has shown great fortitude in challenging circumstances and received praise and admiration for my courage or by someone who is whining about nothing the difference in the 2 responses to me are as challenging to process as they are to account for.

I would therefore appreciate it if you could please follow up with some urgency as the ongoing uncertainty in my Housing and Finances is incredibly stressful and as I have mentioned a few times this situation was only meant to last for 6 to 8 weeks.

Hi Team,



I'm a mixed race disabled lesbian who works on the DE&I Team at Michael Page recruitment agency, and I have several concerns about equality in Sandwell for people of colour.  Prior to moving to Sandwell I had lived in the USA between 1999 and 2004 while I studied Special Education with a focus on Neurodivergency because my brother is autistic.  I have lived in homes and communities as diverse as million dollar houses in Ann Arbor and Grosse Pointe, to tiny rural villages in South Derbyshire, after growing up in local authority owned homes my family rented in Tamworth and Birmingham and in each community I adapted and made friends from all religions, ages and backgrounds, learning about different cultures and ways of life.



I had the misfortune to live in Tipton in an SMBC flat for ten years during which my neighbour Carl Clift repeatedly racially harassed me when I tried to access the communal gardens.  I tried to work with SMBC staff for several years to help Carl understand the communal gardens were for the use of everyone, but after 3 years of thefts, criminal damage, harassment and abuse I was being hospitalised for respite from Carl because my MH was impacted by the relentlessness of the abuse.  A complaint of Harassment was upheld by SMBC and Carl left me alone for a year though he continued to harass my visitors.



Between 2014 and 2017 Tipton ASB Team members repeatedly ignored evidence of Carls escalating abuse and although all of my neighbours (all white skinned) were allowed to store items such as benches, tubs and coal (for example) throughout the communal areas, several members of Tipton ASB Team repeatedly refused me permission to use the communal spaces in the same way my neighbours were able to and threatened me with eviction if I did not remove the item I was attempting to add (such as a hanging basket bracket I tried to put NEXT TO AN EXISTING BRACKET which my neighbour had a basket hanging from etc.)  By now I had been diagnosed with a personality disorder because I was having so many MH crises and episodes (I was in my mid 30's and had never experienced MH issues like that, just a little depression after major life events like deaths.



I challenged this difference in approach multiple times in writing, to which SMBC staff would reply that they would deal with the neighbours separately, but photos and videos demonstrate that no action was taken and these items remained in place through 2010 to 2020, independent sources such as Google maps also demonstrate this.



I made a formal complaint about Carls behaviour and handed Nik Woodridge a 60gig  memory stick containing documents, emails, photos, videos, CCTV footage, audio recordings etc which he had in his possession for six months before returning it stating he had not been able to review the evidence due to a missing codec.  The codec was on the memory stick and this does not explain why he could not review any of the other evidence so I submitted a complaint.



Niks colleague investigated the matter but did not collect the memory stick to review the evidence, instead he reviewed notes made by Nik and Niks Team and made his decision based on that.  I have since asked multiple people across all departments at SMBC to review the actions of this team.  By 2017 my MH was destroyed and when Carl harassed my then 3 and 5 year old nephews I finally lost it and retaliated against him.  This was the first time I had retaliated and it took 7 years before I cracked.  Days later Carl threatened to kill me yet still Nik and the ASB Team refused to take action despite being aware that Carl had assaulted me four times by then in addition to the other incidents.



Niks efforts to protect Carl included forcing everyone in the block to sign a Good Neighbour Agreement (threatening me with eviction if I refused to sign it) and then using that Good Neighbour Agreement to instruct West Midlands Police not to question Carl stating I had agreed to this.



Carl went on to assault me whist installing a gate across the communal gardens, Nik and the Team did not take action against him and last I checked the gate remains in place.  The pain in my left hip was diagnosed as a spinal cord injury for which I needed surgery and now require a wheelchair though I am thankfully still able to walk short distances and when I made a formal complaint about this the response stated "You are unhappy that your neighbour Carl Clift faced no consequences for crippling you, but he was made tow wrote you a letter of apology."



The impact on my already fragile mental health was astounding.  Efforts to highlight the disparity with which SMBC treated Carl and myself have been ignored and my complaints about Tipton ASB Team remain unanswered despite the intervention of numerous Charities and agencies trying to help resolve them and multiple other issues that have arisen as a result of the injuries I received from Carl and the disability they left me with.



During a mental health crisis I threatened to do to Carl and the ASB Team members "what Carl did to me" and another time "you reap what you sow" nothing more and nothing less, which I am not excusing, but I hope explains the context of my threat.  Carl assaulted me four times, threatened to kill me, and then went on to damage my spine during a 5th assault and the most severe consequence he faced was to write me a letter of apology.  I assaulted 0 people, threatened to kill 0 people, limited my threatened actions to only what had been considered OK when Carl was the aggressor yet I was arrested by West Midlands Police and Sandwell MBC IMMEDIATELY threatened me with eviction.



Things got worse in November 2020 when I moved to what was meant to be a wheelchair accessible bungalow owned by Sandwell MBC.  Adaptions were delayed and in November 2021 a kitchen was installed which was meant to be wheelchair accessible but was a fire hazard.  West Midlands Fire Service condemned it in November 2022 but still SMBC staff refused to remedy the fire risks.  I was charged for carers to prepare my meals because I was not allowed to use the kitchen and carers to supervise me in the shower for my safety because the OT refused to allow me grab rails.



I eventually lost my mind and set fire to the kitchen to prevent carers from giving me food poisoning and SMBC bankrupting me in care charges because my home was unsafe.  In September 2023 I was told I had to find somewhere else to stay for 6 to 8 weeks while work was carried out on the bungalow.  14 months later work has not begun and the professional who has been liaising with SMBC since January 2023 with no more success than me, is chasing a late response to a second or third formal complaint.

As one DE&I professional to another I have questions about Sandwell MBC.

  *   Why does SMBC refuse grab rails in the bathroom of a wheelchair accessible bungalow and then force disabled tenants to have carers supervise them in the shower "for their safety?"

     *   Why do SMBC then charge disabled tenants for these carers visits when installing grab rails is cheaper, safer and far less degrading/humiliating?

  *   Why are white SMBC tenants able to harm black SMBC tenants repeatedly without consequence?

  *   Why are white SMBC tenants allowed to install gates across communal gardens and prevent black or mixed race SMBC tenants from accessing them?

  *   Why do black SMBC tenants have to pay the same rent as white SMBC tenants when they are not allowed to enjoy or use the communal spaces in the same way as their white or none mixed race neighbours?

  *   Why does Sandwell MBC charge physically disabled tenants for carers to cook for them because the kitchen is unsafe, when installing a safe, wheelchair accessible kitchen would enable the physically disabled tenant to be independent?

  *   How many requests to SMBC does it take for a black woman to get support to complete a financial reassessment for care charges on average?

     *   How does that number compared to the number of requests white tenants have to submit to SMBC for help for a financial reassessment before receiving it?

  *   How many years does it take for black or mixed race women in Sandwell to be listened to by SMBC staff when raising legitimate and valid concerns about her safety in her SMBC owned home?

  *   Between 2010 and now, how many other black SMBC tenants have been assaulted by white neighbours but not prosecuted?

  *   Between 2010 and now, how many death threats by tenants of one race against tenants of another race have been reported to SMBC staff?

     *   What happened in each case?

I am happy to resubmit these questions as an SAR if necessary, I'm just trying to get an idea on the scale of the issues or whether I was just unfortunate to be in Tipton versus another town.

Dear Ali,

I am following up on my previous request for a copy of the Care Needs Assessment completed on 6 January 2026. I have not yet received it despite multiple written and text requests.

Since that assessment:
• No one has attended to bolt down the toilet frame.
• I am having to hold urine and bowel movements for up to ten hours between calls or request emergency response assistance to avoid falling.
• My health is being impacted by dehydration and bowel retention as a direct consequence.
• The STAR Team have been attending four times daily since 23 January 2026 to act as human grab rails following my injured elbow on 22 January 2026.

This is not an appropriate long-term solution for a bathroom that is not wheelchair accessible, in a bungalow and garden that are also not wheelchair accessible.

I have been informed that attempts by the Community Alarm Team to raise safeguarding concerns have again been blocked by Adrian Scarrott and colleagues.

I am also aware that a response from James McLaughlin regarding earlier escalation is now over a year overdue.

I have a medico-legal assessment on 24 February 2026 relating to my fall on 5 December 2022 and all subsequent documented falls and injuries.

I require the 6 January 2026 assessment for inclusion in my evidence bundle.

Please confirm when I will receive a full copy. I require it no later than 17 February 2026.

I am writing to formally notify you of a fall and ongoing safety risk following my recent discharge from hospital.

I was discharged home on 22/01/2026 with significantly reduced upper-limb function. Since returning home, I have been unable to safely propel my wheelchair or use the toilet independently.

On 23/01/2026, I experienced a near-fall while attempting to access the bathroom. This risk was foreseeable given my injury, fatigue, and the inaccessibility of my bungalow. I have since required multiple emergency and urgent care interventions to meet basic activities of daily living safely.

Community alarm staff have attended and recorded safeguarding concerns.

I am currently receiving short-term support from the STAR team, who are attending multiple times per day to assist me to toilet safely. While their care has been compassionate and professional, this level of intervention highlights that my current environment and support arrangements are not safe or sustainable.

I am notifying you to ensure this incident and the associated risks are formally recorded and treated as an ongoing safeguarding concern, and to request urgent review of:

• the safety of my discharge
• my current living environment
• interim care provision
• and any necessary equipment or adaptations

Please confirm receipt of this notification and advise what immediate steps will be taken to reduce the risk of further harm.

Dear Team Manager,

I am formally escalating the failure to provide me with a copy of my Care Needs Assessment conducted by Ali Asghar on 6 January 2026.

Despite repeated written requests, I have not received the document.

Since that assessment:
• No action has been taken to secure the toilet frame.
• I am holding urine and bowel movements for up to ten hours between care calls or calling emergency response teams to prevent falls.
• My health is being impacted by dehydration and bowel retention.
• Following an injured elbow sustained on 22 January 2026, the STAR Team have attended four times daily since 23 January 2026 to act as human grab rails.

This arrangement is not a sustainable or lawful substitute for making a bathroom wheelchair accessible within a bungalow and garden that remain inaccessible.

I understand attempts by the Community Alarm Team to escalate safeguarding concerns have been blocked by Adrian Scarrott. A response from James McLaughlin to earlier escalation is now over one year overdue.

In addition, I have received rent debt correspondence relating to Manifoldia Grange and continue to experience unresolved council tax and benefits issues (no housing element payments, no disability uplifts).

Floating Support assessment on 6 January 2026 concluded they would not assist with rent, council tax, benefits, or utility debt matters.

I have a medico-legal appointment on 24 February 2026 regarding the 5 December 2022 fall and subsequent documented injuries.

The Care Needs Assessment is directly relevant evidence.

Continued failure to provide it will be documented as part of that process.

Please provide the full assessment immediately and confirm why it has not been released upon request.

If not received by 17 February 2026, I will escalate further.

I would like to request a call from Tracey, my social worker please, I do not have a direct number for her and can't remember her surname.



I have concerns about my safety navigating Manifoldia Grange because this building and grounds are NOT wheelchair accessible and I have had a few falls.  Could we please meet face to face at Manifoldia Grange to look at the challenges and find solutions that will keep me safe during my stay here?



I also need help with the practical challenges of living in a space that is not wheelchair accessible and would like to ask for help to assess this please.



Additionally universal credit ended a call today because I was not able to recall a movie or gig from 40 years ago to pass the security screening.  I was sanctioned because I failed to provide requested information and I would again like to request support with life admin as per my GP notes to both avoid further sanctions, and to address the back log of correspondence that has built up since my last admin support worker was removed two years ago?



My Motability car is not suitable for my wheelchair equipment so I am applying for a grant towards a WAV but i need to provide a letter from universal credit with my home address on it, I have not been able to provide this or complete the process and my existing vehicle is nearing 5 years old, the maximum time the Motability scheme will allow me to keep it.  Could I please request appropriate support to apply to Motability for a new vehicle.



Finally, I would like to ask how to  access the communal space/room/desk at Manifoldia Grange please.

I refer to your email dated 10 February 2026 requesting clarification in relation to the above Subject Access Requests.

For the avoidance of doubt:
I am not narrowing or restricting the scope of any of my Subject Access Requests.

Each SAR relates to all personal data held by Sandwell MBC in any format (including but not limited to email correspondence, internal notes, case management systems, panel discussions, audio records, draft documents, attachments, archived systems, and communications with third parties) concerning me.

These requests cover all relevant departments including Housing, Adult Social Care, Direct Payments, Income Recovery, Governance, Legal Services, Repairs, Occupational Therapy, Safeguarding and associated contractors.

Under Article 12 and 15 UK GDPR, the authority must respond within one calendar month of receipt of the request. Clarification may only be sought where the controller genuinely cannot identify the data. That is not the case here.

Given the long-running nature of my case, the existence of identified reference numbers, upheld complaint findings regarding information handling, and the documented existence of multi-agency records, Sandwell MBC is fully capable of identifying my records without further clarification.

Dear Chief Executive / Monitoring Officer / Director of Neighbourhood Services,

I am writing to raise a formal concern regarding Sandwell Metropolitan Borough Council’s compliance with the Public Sector Equality Duty (PSED) under section 149 of the Equality Act 2010 in relation to the handling of my case over a prolonged period beginning 2010.

Section 149 requires the Council, in the exercise of its functions, to have due regard to the need to:

  1.  Eliminate discrimination, harassment and victimisation;
  2.  Advance equality of opportunity between persons who share a protected characteristic and those who do not;
  3.  Foster good relations between such persons.

This duty applies to strategic decision-making, policy implementation, housing management, community safety responses, complaints handling and safeguarding processes.

For clarity, I am a mixed-race woman (White and Black Caribbean), gay, autistic, ADHD, and have documented mental health conditions. I later sustained a life-altering spinal injury following an assault. These characteristics were known, or reasonably should have been known, to the Council during the relevant period.

My concern is not framed as an allegation of individual malice, but as a question of statutory compliance.

Elimination of Discrimination and Harassment

Over a number of years, I reported repeated harassment, assault and threats by a neighbour. I explicitly reported racial hostility, including references to me as “that black woman.” Despite this, the matter was repeatedly characterised as a “neighbour dispute,” and mediation was offered on multiple occasions.

I have seen no evidence that racial hostility was formally analysed, recorded or escalated within an equality framework. I have also seen no written indication that my protected characteristics were weighed in enforcement decisions, threshold determinations, or community trigger outcomes.

I therefore request confirmation of:

• Where and how racial hostility was assessed in decision-making records;
• Whether any equality impact assessment was undertaken in relation to ASB handling;
• How cumulative harm to a disabled, mixed-race resident was evaluated.

Advancing Equality of Opportunity

The duty requires public bodies to remove or minimise disadvantages suffered by persons with protected characteristics and to take steps to meet different needs.

Throughout this period I was autistic, ADHD and experiencing trauma and burnout. I was required to navigate complex complaints procedures, repeated reporting processes, and digital systems without reasonable adjustment or tailored support.

Additionally, a housing placement decision was made while I was traumatised following prolonged insecurity in a previous property. I have seen no evidence that my neurodivergence, trauma history, or safeguarding context were embedded in that decision-making process.

Please confirm:

• Whether vulnerability and disability were formally factored into housing allocation and risk assessments;
• Whether reasonable adjustments were considered in complaints handling;
• How neurodivergence and trauma were accounted for in mediation suitability assessments.


Fostering Good Relations

Where racial hostility was alleged, the Council was under a duty not only to process complaints procedurally but to address prejudice and reduce hostility.

I request clarification as to:

• What steps were taken to address racial hostility as a community relations issue;
• Whether any equality-based enforcement considerations were applied;
• How the Council satisfied itself that offering mediation in a power-imbalanced and racially charged context met its statutory obligations.


Strategic Governance

The portfolio responsible for Community Safety, Housing Services, Complaints and Customer Experience is required to exercise PSED at a strategic level. PSED compliance cannot be implied; it must be demonstrable.

In public law, absence of evidence that due regard was given may indicate that the duty was not discharged.

Accordingly, I request:

  1.  Copies of any Equality Impact Assessments, equality analyses or PSED considerations undertaken in relation to my case;
  2.  Confirmation of how my protected characteristics were embedded in decision-making processes;
  3.  An explanation of how the Council satisfied itself that its responses complied with s.149 Equality Act 2010.

This correspondence is intended to clarify governance compliance and does not preclude further escalation to appropriate oversight bodies should satisfactory evidence of PSED compliance not be provided.

I would appreciate a substantive written response addressing each limb of the Public Sector Equality Duty directly.
